Scottish planning documents describe separate requirements for environmental assessment and notification of ministers. A report of campaign concerns about emissions is a different source of evidence about the policy debate.
Scotland data centre emissions and the EIA Direction
The Chief Planner’s September letter describes an EIA Direction taking effect on 17 September 2026. Its operative text covers data centres exceeding 50 MW that also fall within the specified industrial-estate or urban-development descriptions in the EIA regulations. The letter says proposals below the threshold remain subject to case-by-case consideration. It should not be read as saying that every smaller project is exempt from assessment.

Notification is a separate procedure
The Scottish Government’s separate announcement describes a notification direction requiring planning authorities to notify Scottish Ministers of new applications exceeding 50 MW within seven days of validation. It also discusses particular appeal and assessment decisions. That notification procedure should not be conflated with the September EIA Direction or presented as the same rule for every UK jurisdiction.

Keep campaign criticism attributed
The Guardian’s May report attributes concerns about emissions accounting and the policy definition of green data centres to Action to Protect Rural Scotland. The later Chief Planner letter discusses construction and operational emissions, fossil-fuel use and location-dependent impacts. Neither document establishes that a green label alone proves zero emissions, or that the later directions have already resolved every concern raised by campaigners.
