AI Surveillance of UK Employees: ICO Monitoring Guidance

The ICO’s worker-monitoring guidance describes data-protection obligations when employers collect information about staff. Those obligations matter when AI is added to monitoring tools as well as when conventional software is used.

Purpose and limits of worker monitoring

The ICO says monitoring must be lawful and fair, and warns that excessive collection can intrude into private life and undermine wellbeing. Its guidance covers both routine systematic monitoring and occasional monitoring introduced for a particular need. Separately, a Guardian podcast page points to reported stress among teachers whose work was rated using AI. That report illustrates a concern; it does not establish how common that experience is across employers.

Lawful basis for AI surveillance of UK employees

The ICO says an employer must identify an appropriate lawful basis for processing monitoring information. Where special-category data is collected or likely to be collected, an additional processing condition is required. Its guidance explains that contractual necessity is unlikely to be suitable for ordinary business-improvement monitoring: simply adding a monitoring clause to an employment contract does not make the collection necessary.

Transparency, collection and retention

The guidance says workers must receive accessible information about how and why they are monitored. It also says collection must be limited to what is needed for the purpose and that retention must be justified, rather than keeping information in case it becomes useful. These are data-protection considerations in the cited guidance; an AI label does not establish that a particular monitoring scheme is lawful.
